FCRA – FOREIGN DONATION POLICY

Giridham Art and Culture Foundation (“Foundation”, “we”, “our”, or “us”) is a registered non-profit organization engaged in cultural, educational, social, and charitable initiatives across India.

This policy governs the acceptance, utilization, compliance, and reporting of foreign contributions in accordance with the Foreign Contribution Regulation Act (FCRA), 2010 and rules framed thereunder.


1. Legal Framework

Foreign donations are regulated under:

  • Foreign Contribution Regulation Act, 2010

  • Foreign Contribution Regulation Rules, 2011

  • Ministry of Home Affairs (MHA), Government of India

The Foundation strictly complies with all FCRA statutory provisions.


2. FCRA Registration Status

The Foundation currently does not hold permanent FCRA registration. Foreign contributions may be accepted only after obtaining prior permission from the Ministry of Home Affairs for specific projects/donors.

Foreign donors are advised to contact the Foundation before initiating transfers.


3. Designated FCRA Bank Account

As per FCRA Amendment Act, 2020:

All foreign contributions must be received only in the designated FCRA account.

4. Eligible Foreign Contributions

Foreign contributions may include:

  • Donations from foreign individuals

  • Grants from international NGOs

  • Contributions from foreign corporations

  • Institutional funding

  • Cultural exchange grants

  • CSR funds from foreign entities


5. Prohibited Foreign Sources

The Foundation shall not accept foreign contributions from prohibited sources such as:

  • Foreign political parties

  • Foreign government agencies (without approval)

  • Terror-linked entities

  • Anonymous foreign donors

  • Entities restricted by MHA


6. Purpose of Utilization

Foreign contributions shall be utilized strictly for charitable objectives, including:

  • Art & cultural preservation

  • Tribal welfare programs

  • Educational initiatives

  • Skill development training

  • Community upliftment

  • Heritage conservation

  • Women & youth empowerment

Funds shall not be used for personal or commercial gain.


7. Administrative Expense Compliance

Administrative expenses from foreign funds shall not exceed the statutory limit (currently 20%) unless prior government approval is obtained.


8. Reporting & Disclosure

The Foundation ensures full transparency by:

  • Filing annual FCRA returns (Form FC-4)

  • Maintaining donor records

  • Keeping utilization statements

  • Submitting bank statements

  • Maintaining project-wise accounts

All filings are made with the Ministry of Home Affairs within prescribed timelines.


9. Donor Documentation Requirements

Foreign donors may be required to provide:

  • Passport copy / Incorporation certificate

  • Address proof

  • Purpose of donation

  • Commitment letter / Grant agreement

  • KYC documents (if required)


10. Currency & Conversion

Foreign donations may be received in:

  • USD

  • EUR

  • GBP

  • AUD

  • CAD

  • Other permitted currencies

Conversion shall be as per bank exchange rates.


11. Refund & Repatriation

Foreign donations are non-refundable except where:

  • Required by law

  • Directed by MHA

  • Donation received in error

Any refund shall follow RBI & FCRA compliance procedures.


12. Prohibited Activities

Foreign contributions shall not be used for:

  • Political activities

  • Election funding

  • Religious conversion activities (if restricted)

  • Speculative investments

  • Personal benefit of trustees/members


13. Suspension / Cancellation Compliance

In the event of FCRA suspension or cancellation:

  • No foreign funds shall be utilized without approval

  • Funds shall be managed as per MHA directions

  • Donors shall be notified where required


14. Policy Amendments

The Foundation reserves the right to amend this policy in line with statutory changes or regulatory updates.
